CIASCO_Application.pdf, One document to do in this file
This application gives you a good summary of what the matter is about. We don't want people joining in if they don't know what the action is about.

CIASCO_Affidavat.pdf; One document to do in this file.
Remember your Affidavit must be witnessed by a Justice of the Peace or other qualified person such as police sergeant, or chemist etc. Many people get their documents witnessed at police stations or a local Court, whilst others have a favorite J.P.

CIASCO_Power_of_Attorney.pdf, Two documents to do in this file, Power of Attorney and Consent to be a Plaintiff. The Power of Attorney is limited to this matter only.

After downloading, what do I do next?
1. Choose the level of your support for this action. (Two choices, plaintiff or supporter/verifier)
A supporter/verifier is not listed as a Plaintiff before the court, but as a person who verifies and supports the action as a member of the community. Plaintiffs have more authority and standing before the court than verifiers. A verifier is not as important to the court as a Plaintiff, but does prove the public interest aspect of the matter to the court. Because a Plaintiff has standing, a Plaintiff in his own right can seek to make submissions to the court from the bench, but a verifier cannot. A Plaintiff can receive payment for damages, but a verifier cannot.

2. Download and complete the documents.

3. Either post or email your documents to CIASCO
Posting.
Simply post your documents to CIASCO at P.O. Box 960, Mt. Lawley, WA. 6929 and then phone Elaine on 08 9440 3661 to let her know that you posted it.
Emailing
Emailing your signed and witnessed documents is a four step process.
If you have not scanned signed documents before then this job can be a bit tricky.
a)..Buy a scanner
b). Buy or download some good scanning software. I use Adobe program. Not the reader program which is free, but the actual software which you pay for. I bought my version 5 many years ago, which still does everything I need. Your software must support saving as pdf. (Portable Document File)
c) Scan your document at 300 dpi, in text enhanced or black and white mode. We only accept pdf documents. We do not accept formats known as jpg, tiff, bmp etc. these are too big and cumbersome.
d) Attach your scanned document in pdf format and send to us at ciasco@safe-mail.net and then phone Elaine on 08 9440 3661 to let her know that you emailed it.

But I cannot do pdf format, only jpg, tiff or bmp. What do I do now?
In this case you can email your signed documents to bronwyn at vaccinfo@bigpond.com and she will convert to pdf for you and forward them onto us at ciasco@safe-mail.net. You can also fax your documents to (02) 8021-6627, but because the quality of faxed documents is not as good as scanned or photocopied documents, then facsimile is a last resort or quick remedy pending posting or emailing of the higher quality document.

4. Volunteer to contribute some $ to CIASCO
Unlike solicitors we are volunteers, and don't get paid for the work we do for you, but we still have large costs and overheads. Running a class action is NOT CHEAP.
You decide how much. Even $20 is better than nothing.

How much do I contribute?
I guess this comes down to how much you value your rights and your freedom. Regarding costs, generally we ask of Plaintiffs to contribute at least $20 toward costs, though $50 is what is really needed. We won't quibble however, because one of our objective is to encourage community support, and community involvement for solving community and political problems. The more electors that support the action the better, and we certainly won't allow $ to stand in the way of your joining the action. If you absolutely cannot afford anything, then just join anyway as either a plaintiff or a verifier.
On the application form some suggestions are put, but really its up to you.

What about legal costs? How can we afford to do this action?
Because Malcolm McClure has done the paperwork and volunteered his time and expertise for this matter, it is Malcolm who has paid the price for you and for this action. To this date he has saved the Plaintiffs in the action over $200,000 in solicitor costs, which is the starting cost of a class action of this magnitude. Before the matter is over, Malcolm would have saved you at least $500,000. The cost to Malcolm is great, both personally and financially, and he is willing to bear this cost provided there is community support.

Will I have to pay any other costs if we lose? Can I lose my house?
No. Losing your house may be real if you do your own court action by yourself. Many have heard of those cases when single individuals go to court, and must pay huge fees to lawyers and solicitors and then afterwards lose their houses. But did you know, that in nearly all cases it is the solicitor that is working for you that takes your house. It is your solicitor and your lawyer that in the vast majority of cases takes the most of your money. In this matter there is not a solicitor working for you, it is Malcolm who is working for you, and he is doing this work for free. Malcolm does not want your house or anything for the work he is doing, only that you support him and don't complain.

What about court costs and court fees. Who pays?
Members of this action of CIASCO have paid with their donations. So far about $1200 has been spent in filing fees. This is what your donation is for.

But what about the Defendants costs if we lose. Won't it cost hundreds of thousands?
The idea of huge costs in the orders of hundreds of thousands, for a matter such as this, is a myth. Costs for the other side are limited to what the law provides for. There is a schedule of fees, and the other side just cannot make up a figure and charge you anything it likes. Notwithstanding however our position is that:
a) each party should pay its own costs or
b) the government should pay all costs because the matter is in the public interest.

Remember that, costs are a tactical weapon used by the courts and the legal fraternity to discourage you from joining into community court actions. This tactical weapon works, which is evidenced by the fact that for most men and women their fear of a financial loss overrules their principles and their values.

Remember also, that the biggest costs are nearly always from your own solicitors and lawyers who are meant to be working for you and for your matter, and in this case Malcolm is doing the work for you and for our communities for free.
